What Is a Premises Liability Case?

The Supreme Court of Nevada has ruled that landowners owe a duty of reasonable care to everyone who enters a property. This duty applies to everyone, including those who are not invited. A property owner must foresee possible dangers and fix them, or they can be held accountable in a court of law. This includes both natural and artificial conditions that pose risks to someone using the property, even if those risks are “open and obvious”.

Examples of Premises Liability Cases

There are many types of accidents that fall under the umbrella of Premises Liability. Some common examples include:

Slip and Fall

These are a very common occurrence and can be caused by a variety of issues, including:

  • Defective staircases
  • Snow/ice
  • Slippery floors
  • Cords and cables
  • Loose tiles

Inadequate Building Security

These cases can arise in residential buildings or offices. It is an owner’s responsibility to secure access to the building. If a thief walks into an office building in broad daylight and assaults someone in the building, a premises liability case against the building owner can be successful if reasonable steps to secure the building did not occur.

Swimming pool accidents usually involve an unsecured and unsupervised pool. Almost every state has laws regarding fencing and locks to keep children out. A homeowner who fails to properly secure access to a pool may be liable in a premises liability case.

More examples:

  • Animal and dog bites
  • Inadequate maintenance
  • Elevator and escalator accidents
  • Fires
  • Leaks
  • Toxic fumes or mold

Premises liability cases are oftentimes complex and difficult to prove. It must be proven that the person who caused the injury does in fact own the property, and that they knew or should have known about, and fixed, the hazard causing the injury.

It is important to seek medical advice on all injuries right away – a doctor’s testimony is often helpful in these types of cases. Also refrain from making any statements to insurance companies before consulting with your Henderson premises liability attorney.
